These Terms and Conditions (the "Terms") govern the Cash Back Program (the "Program") offered by Ali Realty Group Inc., Brokerage ("the Brokerage," "we," "us," or "our") to eligible home buyers in Ottawa and the surrounding area ("you," "your," or "Client"). By requesting a cash back estimate, signing a Buyer Representation Agreement that references the Program, or otherwise taking part in the Program, you agree to these Terms.
Example: on a $50,000 buyer agent commission, your cash back would be $25,000 (50% of $50,000).
No rebate is payable where:
If you're financing your purchase, discuss the rebate with your mortgage lender before proceeding — some lenders place conditions on rebates or incentives tied to a real estate transaction. It's your responsibility to confirm the rebate is permitted under your financing arrangements and to meet any disclosure requirements your lender sets. The Brokerage will disclose the rebate on transaction or closing documents where required by law, but you remain responsible for giving your lender accurate information.
Being part of the Program doesn't reduce the representation you receive. Subject to your BRA, this can include:
Taking part in the Program requires a valid BRA with Ali Realty Group Inc., Brokerage, setting out the scope and duration of representation and the applicable commission arrangements. These Terms, the BRA, and any separate rebate agreement should be read together; where they differ on the rebate for a specific transaction, the specific written terms signed for that transaction govern.
Ali Realty Group Inc., Brokerage is registered with the Real Estate Council of Ontario (RECO) and operates under the Trust in Real Estate Services Act, 2002 (TRESA) and its regulations. The Program is administered in line with applicable disclosure, representation, and remuneration requirements, and remains subject to the direction of the relevant regulatory authorities.
A rebate may carry tax or reporting implications depending on your circumstances. Get independent advice from a qualified tax professional about your specific situation — Ali Realty Group Inc., Brokerage and its agents don't provide tax advice and aren't responsible for your tax treatment or reporting obligations.
The rebate is payable only to the buyer(s) named in the applicable BRA and can't be transferred, assigned, or paid to any other person or entity.
Ali Realty Group Inc., Brokerage may revise, pause, or discontinue the Program at any time. Changes apply to new participants and future arrangements only — they won't alter a rebate already established in a signed written agreement for an active transaction, which continues to be governed by its own terms.
The Brokerage's financial obligation under the Program is limited to the rebate amount set out in the applicable signed agreement. To the extent the law allows, Ali Realty Group Inc., Brokerage isn't responsible for indirect, incidental, or consequential losses arising from the Program. Nothing here excludes or limits any liability that can't lawfully be excluded or limited.
